Important USCIS Updates This Week

This week’s immigration updates include a visa cap announcement, a DOJ statement about immigration court arrests, a Supreme Court asylum case, and reports about ICE officers at airports. Here’s a practical overview of what you should know. 👇

1️⃣ H-2B cap reached for second half of FY 2026 🛂

USCIS announced that the H-2B visa cap for the second half of fiscal year 2026 has been reached. New cap-subject petitions for start dates between April 1 and September 30, 2026 will be rejected if filed after the final receipt date. USCIS also released filing dates for supplemental H-2B visas that may become available later in the fiscal year.

2️⃣ DOJ says immigration courthouse arrests relied on incorrect memo🕵️

The Department of Justice stated in court filings that it had relied on incorrect ICE guidance when defending arrests made at immigration courthouses. The memo previously cited in court did not actually authorize arrests in immigration courts. The issue arose in ongoing litigation challenging courthouse arrest practices.

3️⃣ Supreme Court reviewing asylum processing policy ⚖️

The Supreme Court is reviewing a case involving a policy that limits how many asylum seekers can be processed at border entry points. The case focuses on when a person is legally considered to have “arrived” in the United States for asylum purposes. The decision could have major implications for border asylum processing.

4️⃣ ICE officers assisting at some airport checkpoints ✈️

Reports indicate that immigration enforcement officers have been deployed to assist at certain airport security checkpoints during a Department of Homeland Security funding dispute and staffing shortages. The move has raised questions about the expanding role of immigration enforcement in transportation security.
