
Major Policy Shifts, Court Rulings & Practice Update
This week brought sweeping changes to immigration policy, major courtroom victories, and concerning developments inside immigration courts.
‼️TPS for Burma Is Ending
After reviewing current conditions in Burma, DHS has decided that Temporary Protected Status will officially terminate on January 26, 2026. According to Secretary Kristi Noem, Burma has made “notable progress in governance and stability,” including:
✔️ End of the state of emergency
✔️ Ceasefire agreements
✔️ Movement toward democratic elections
✔️ Better public service and local administration
Burmese nationals should now begin planning for life after TPS — extensions will not continue. Those departing the U.S. are encouraged to report their departure using the CBP Home app.
⚖️ Federal Court Blocks Mandatory Detention Policy
In a major due-process win, a federal judge ruled that the Trump administration cannot deny detained migrants the right to ask for bond. Judge Sunshine Sykes certified a nationwide class, meaning thousands of individuals who were living in the U.S. before being detained can now seek release while their immigration cases continue.
This ruling strikes at the heart of a policy that attempted to treat long-term U.S. residents as if they were recent border arrivals — a dramatic expansion blocked by the court.
🚨 5 More Immigration Judges Fired in San Francisco
The Department of Justice has removed five additional immigration judges, all known for high asylum-grant rates — some between 90%–96%, far above the national average of 41%. This brings the total judges fired in San Francisco this year to twelve.
With only nine judges remaining and a historic case backlog, attorneys warn this will:

⛔ Force traumatized asylum seekers to retell their stories
⛔ Increase uncertainty for families seeking protection
Meanwhile, DHS is actively recruiting new “deportation judges” with salaries exceeding $200,000 and sign-on bonuses.
