Important USCIS Updates This Week

Screening Changes, Fraud Enforcement, H-2B Cap, TPS Yemen Update & Scam Alerts. Here’s a practical overview of what you should know. 👇

1️⃣ DHS proposes asylum screening and work authorization changes 📑

DHS has introduced a proposed rule aimed at strengthening vetting and revising eligibility standards for employment authorization tied to pending asylum applications.

USCIS currently reports over 1.4 million affirmative asylum cases pending. The proposal would adjust filing and eligibility requirements to reduce incentives for meritless filings and shift agency resources toward adjudication of pending claims.

The rule will be open for public comment for 60 days after publication.

2️⃣ Immigration fraud scheme charged in New York ⚖️

Federal prosecutors announced indictments and arrests in an alleged immigration fraud operation in New York.

According to court filings, defendants are accused of operating a fictitious immigration law firm, charging clients for non-existent services, and impersonating immigration officials during staged virtual proceedings.

Charges include wire fraud, money laundering conspiracy, and impersonation of federal officials. All charges remain allegations unless proven in court.

3️⃣ H-2B supplemental cap reached for returning workers 📊

USCIS confirmed that the additional 18,490 H-2B visas allocated for returning workers under FY2026 have been fully requested.

Because filings exceeded availability, the agency conducted a computer-generated selection process for petitions received during the first five business days of filing. Premium processing has now begun for selected petitions.

4️⃣ TPS designation for Yemen set for termination 🌍

DHS announced the termination of Temporary Protected Status for Yemen, effective 60 days after publication in the Federal Register.

Yemen had been designated since 2015 due to armed conflict conditions and had been extended multiple times. Individuals without another lawful basis to remain may become subject to removal after the effective date.

5️⃣ Immigration scam alerts and verification reminders 🚨

Federal agencies continue to warn about scams involving impersonation of immigration attorneys, nonprofits, and government officials — often through Facebook, Instagram, and WhatsApp.

Victims have reported financial losses and missed court appearances after relying on fraudulent services. Individuals are advised to independently verify legal providers and report suspected fraud to appropriate authorities.
